1. Scope of Application

These General Terms and Conditions (AGB) apply to the relationship between Banana Beauty (hereinafter "The Brand") and the content creator (hereinafter "The Creator") participating in the UGC (User Generated Content) program.

2. Subject of the Contract

The Creator applies to receive free products from The Brand. In exchange, The Creator agrees to produce authentic User Generated Content featuring these products. The specifics of the content (format, platform, quantity) will be agreed upon confirmation of the application.

3. Granting of Rights

By submitting content to The Brand, The Creator grants The Brand a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, distribute, display, and perform the content in connection with The Brand's marketing and promotional activities. This license is valid for a period of 24 months from the date of submission.

4. Content Standards

The Creator warrants that all content submitted is their original work and does not infringe upon the intellectual property rights of any third party. Content must not contain any defamatory, obscene, or unlawful material.

5. Liability

The Brand is not liable for any damages or injuries arising from the use of the products, except in cases of willful misconduct or gross negligence.

2. Data Collection

We collect the following personal data when you apply:

Name and Contact Information (Email, Phone)
Shipping Address
Social Media Handles and Public Metrics (Follower counts, Engagement rates)
Content preferences and motivation

3. Purpose of Processing

Your data is processed for the following purposes:

Evaluating your suitability for our UGC program.
Shipping products to your provided address.
Communicating with you regarding your application and content.

4. Data Sharing

We do not sell your personal data. Your shipping information will be shared with our logistics partners solely for the purpose of delivering products.

5. Your Rights

You have the right to access, correct, or delete your personal data at any time. You may also withdraw your consent for future processing by contacting us.
